@Ymar: Precisely. When they apprehended the guy, the option was in force and in my view, we ought to offer a lot of leeway in terms of what was "required" to bring the perp in. It's wrong for a one or more people sitting in safety to make fine judgments about what the guy whose a** was on the line considered necessary to stay safe while completing the mission. Any doubtful situation should be decided in favor of the SEALs.
My point is that once they got him back to base and in his cell, if someone THEN went back and worked him over in cold blood, THAT is something that can't be condoned. We could argue about the sanctions appropriate to the situation, but we can't ignore it, or act like it's OK.
And I repeat: my first assumption is that the terrorist is lying, not our guys.

But I’m also very clear that we MUST NOT condone our guys getting carried away, and in cold blood abusing their power position in order to take out their frustration, anger, fear, or whatever other legitimate emotion, on prisoners.
I hope that makes sense.

These are SEALs. If they wanted to abuse the target, they'd have put rounds in its head just like they did the Somalian pirates a few months ago. This was a capture or kill mission; they had a choice.

It would be a good thing, from my point of view, to know some details about the case....
If this guy got beat up a bit while the apprehension was taking place, then the SEALs should never have been brought up on charges. If their commander thought that a fat lip meant too much force had been used, he could have had a chat with them.
On the other hand, if someone went back to the cell where they guy was being held and worked him over, for whatever reason....then it seems to me that an investigation and even punishment would be a righteous outcome.
Now, I'm biased in favor of our guys, and I suspect VERY strongly that this piece of human debris fattened his own lip in order to make exactly this allegation. But I'm also very clear that we MUST NOT condone our guys getting carried away, and in cold blood abusing their power position in order to take out their frustration, anger, fear, or whatever other legitimate emotion, on prisoners.
I hope that makes sense.

I wrote my representative yesterday.

It isn't as if we send Seals or anyone in the military to corral four year olds. And what really concerns me is that while I don't want to see them prosecuted, it doesn't really matter now whether they are or are not. The damage is done: what military person will go the extra mile knowing they may face prosecution?
