This is what bugged me when everyone was all up in arms because “they gave the terrorists their right to remain silent.” Sorry but the always had that right. All that happened was that the government decided whether they would respect that right and we also discuss just how hard we will allow the government test a suspects ability to remain silent.

The government does not give you the right to remain silent. All they can do is respect your right. Enforce penalties when one of their agents fail to respect your right. And decide just what procedures they will permit to test your ability to exercise your right, from polite questioning to waterboarding, with rubber hoses in between.

Imagine the Founding Fathers trying to put forth the Bill of Rights today. Instead of creating clarity and tight concise rules of law – it would make the next round of Wikileaks and all 400,000 pages look like a pamphlet.
