BLM & Lawfare in California

A Contra Costa couple is being prosecuted by a George Soros funded DA for the “hate crime” of painting over a “BLM Mural.” They need to sue the DA and the city for libel and violating their right to freedom of speech.

Several days ago, a couple in California, upset at a “Black Lives Matter mural” printed in the street outside a government building, painted over it.

You can hear the couple arguing with others as the woman obliterates the “mural.”  Their complaint is not that “black lives” don’t matter, it is that “all lives matter” and that the BLM movement is pushing false narratives.  That is political, not racial.

The Contra Costa County, California, District Attorney is a progressive, Diana Becton, shown above with the man who funded her run for office in 2018, billionaire George Soros.  Becton has stated that she intends to prosecute the couple for hate crimes.  This from her press release:

Two Martinez Residents Charged with Hate Crime for Defacing Black Lives Matter Mural

Martinez, Calif. – Today, the Contra Costa County District Attorney’s Office charged Nicole Anderson (42-years old Martinez resident) and David Nelson (53-years-old Martinez resident) with three misdemeanor counts, including a hate crime, for their alleged actions on Saturday, July 4, when defendant Anderson covered up a Black Lives Matter mural with black paint. Nelson directly aided in the alleged criminal conduct. The incident was captured on video by witnesses.

On July 1, a local Martinez resident applied for a permit to paint a Black Lives Matter temporary mural in downtown Martinez in front of the Wakefield Taylor Courthouse. The permit was approved by the City of Martinez and the painting was done on July 4.

Nelson and Anderson arrived at the scene of the mural after it was completed with paint supplies. Anderson started to paint over the yellow letters “B” and “L” in the word “Black.” She used black paint and a large paint roller to do so. The video has been shared widely by witnesses and shared on social media.

“We must address the root and byproduct of systemic racism in our country. The Black Lives Matter movement is an important civil rights cause that deserves all of our attention,” stated Contra Costa County District Attorney Diana Becton. “The mural completed last weekend was a peaceful and powerful way to communicate the importance of Black lives in Contra Costa County and the country. We must continue to elevate discussions and actually listen to one another in an effort to heal our community and country.”

In total, both defendants are charged for the following alleged offenses:

  • Violation of Civil Rights, PC 422.6(b)
  • Vandalism Under $400, PC 594(a)
  • Possession of Tools to Commit Vandalism or Graffiti, PC 594.2(a)

This DA is using her position to criminalize politics with which she disagrees.  It is an extension of the cancel culture, though this time with the police power of the state in service.

The First Amendment protects political, symbolic speech.  If the First Amendment protects burning the American flag, then it protects painting over a BLM mural painted on public property.  And to equate opposition to BLM with racism is not merely outrageous, it is a libel.  I hope and pray that the couple fights back against this progressive DA, not merely in the local criminal court, but in a federal civil trial as well.  This woman and the influence of her mentor, George Soros, need to be driven out of that DA’s office.
