Can a President use an executive order to override the Constitution?

Today’s question:  Can President Obama use an executive order to override the Constitution?

Today’s answer, courtesy of Matt Drudge is “yes, he can, but it won’t be pretty.”  (Click on image to enlarge.)

If, as Biden say, saving one life, is worth taking action, shall we start to list all the possible things we will have to ban?  cars, planes, eating…?

Over at OTB, I suggested “gun proofing” kids in response to their claim against firearms in the home.  By Gun proofing, I mean teaching kids about guns, gun safety, how to safely handle, etc. to remove the allure of taboo, so they can understand real guns and safely handle the gun if they must touch it, i.e., it is accessible by younger kids or ones not gun-proofed.  You know if the kid comes across a gun in someone’s home, in the bushes, where a cop has left it in the bathroom stall, etc.
Well, I was quickly informed that it wouldn’t work.  A kid could still mishandle the gun.  And were terribly unconcerned that it was something to do for little cost even if it only saved one life.
Seems the saving one life only applies to denying people the right to an effective self defense.

The left is in triumphalist mode at the moment, drunk on the 2012 election.  But I concur with Krauthammer tonight, – if the left tries to confiscate weapons, they will face an armed insurrection.
I would add that the only thing that prevents us from true armed insurrection at the moment is respect for the rule of law.   But the more that rule of law is contravened, the closer indeed do we come to a real insurrection.  The fuse will be lit when a group of normal, everyday citizens stand armed in the public square, prepared to engage in civil disobedience and to accept the consequences.  It took one person to ignite the Arab Spring.  I honestly think that it will take nothing more than for this President to overreach and some brave souls to take a stand with their lives to ignite something similar in the U.S.
I don’t think this President – or most on the left, for that matter – are that stupid.  The President can neither override the Constitution nor alter federal law by executive order.  To the extend he has succeeded in doing so in the last term, it was only because the House did nothing to take a stand on the issue.  But if he tries that with guns, I would expect Texas and a few other states to immediately make it an issue – and talk of secession to become a bit more serious.

Actually I was going to guess that if Obama were to do anything by Executive Order, it would be in regards to recordkeeping on gun owners . . . . but see . . .
    I am still laughing.

Isn’t it beyond odd that you haven’t heard about THIS?

    Gunman killed at Sullivan Central
On Monday morning, Thomas Richard Cowan loaded 13 bullets into two handguns, left his German shepherd chained to the fence and drove eight miles from his home in Kingsport to Sullivan Central High School. Whatever his mission, it was the 62-year-old Vietnam veteran’s final drive.
For about an hour, Cowan’s armed invasion spread panic throughout the school before a burst of officers’ gunfire brought him down. No others were injured.

Here’s a video of how a gun confiscation might occur.  Or i guess how such confiscation might turn out.

Furthermore, until a few minutes ago, I hadn’t heard about this (bless the UK Daily Mail):

Cult YouTube gun channel boss found shot dead on rural Georgia road

Keith Ratliff was found shot to the head but had cache of weapons near him
He ran YouTube channel with three million subscribers and all videos combined have been viewed more than a HALF BILLION times
32-year-old man leaves behind a wife and two-year-old son

If you want to stand up and cheer, watch Joshua Boston, the Marine who sent Diane Feinstein the letter saying he would never give up his guns, school the complete prat, Piers Morgan:

Joshua Boston, the former Marine who sent an open letter to Senator Dianne Feinstein slamming her gun control proposal, appeared on CNN Tuesday to face a rather muted Piers Morgan. Boston believes that more guns, not more gun legislation, are the answer and Morgan pressed him on his logic, asking, “Where does that lead America, other than utter, Wild West hell?”

“We cannot continue to rely only on our military in order to achieve the national security objectives that we’ve set. We’ve got to have a civilian national security force that’s just as powerful, just as strong, just as well-funded.”
    – Barack Obama
p.s. DHS purchased almost 2 billion round of ammunition during 2012. When the Army makes a big ammo purchase, nobody blinks an eye, but when the Social Security Administration, the National Oceanographic and the Atmospheric Administration’s National Weather Service make big buys, you might want to stop and ask “why”?

If memory serves, the office of the President of the United States is something that was created by and derives its legitimacy from Article II of the US Constitution.  Without the Constitution, the President of the United States is is no more meaningful than the Baron of San Jose, the Earl of Las Vegas, the Duke of Ft. Lauderdale, or His Grace the Supreme Janitor of the Mississippi Valley.  If this so-called President of the United States thinks he can ignore one part of the Constitution while still claiming power under a different part of a “living document,” I will dispatch the Fuzzy Pink Bunny of Cleveland to repo the jet and the teleprompter, and the Undersecretary of Narnia to lecture him sternly and give him a wedgie from Hell.
It’s time for a little Calvinball.

    Wolf Howling # 4:
“The President can neither override the Constitution nor alter federal law by executive order.”
He also can’t have Michelle wear a bra gun in Chicago.  So what, if he gets away with it.
